Terms and Conditions
Article 1 - Definitions
- Blooms: the online webshop offering flowers and related products.
- Customer: the natural or legal person entering into an agreement with Blooms.
- Agreement: the purchase agreement between the customer and Blooms.
- Products: all items offered by Blooms on the webshop.
- Cooling-off period: the period within which the customer can exercise the right of withdrawal.
- Right of withdrawal: the possibility for the customer to withdraw from the agreement within the cooling-off period.
Article 2 - Applicability
- These terms and conditions apply to all orders and agreements via the Blooms webshop.
- By placing an order, the customer accepts these terms and conditions.
- Deviations from these terms are only valid if agreed upon in writing.
Article 3 - Offer and Agreement
- All offers on the webshop are non-binding and may be changed at any time.
- An agreement is established when the customer places an order and Blooms confirms it.
- Blooms reserves the right to refuse an order or impose additional conditions.
Article 4 - Prices and Payment
- All prices on the webshop include VAT and exclude shipping costs, unless otherwise stated.
- Payment can be made via the payment methods offered on the webshop.
- The order will only be shipped after full payment is received.
Article 5 - Delivery and Shipping Costs
- Blooms aims to deliver the order within the specified delivery time.
- Shipping costs are clearly stated during the ordering process.
- If delivery is delayed, the customer will be informed.
- The risk of damage or loss of products transfers to the customer upon delivery.
Article 6 - Right of Withdrawal and Returns
- The customer has the right to withdraw from the agreement within 14 days of receipt without providing reasons.
- During the cooling-off period, the customer must handle the products with care.
- Return shipping costs are borne by the customer unless otherwise agreed.
- Flowers and perishable products are excluded from the right of withdrawal.
Article 7 - Complaints and Warranty
- Blooms strives to deliver products in optimal condition.
- Complaints about delivered products must be reported within 48 hours of receipt.
- If a product is defective, Blooms will offer an appropriate solution.
Article 8 - Liability
- Blooms is not liable for damage caused by improper use of the products.
- Blooms' liability is limited to the purchase price of the respective product.
Article 9 - Force Majeure
- In case of force majeure, Blooms has the right to suspend or terminate the agreement without compensation.
Article 10 - Privacy and Data Protection
- Blooms processes personal data in accordance with applicable privacy legislation.
- Data will not be shared with third parties unless necessary for the execution of the agreement.
Article 11 - Applicable Law and Disputes
- These terms and conditions are governed by Dutch law.
- Disputes will preferably be resolved through mutual consultation. If this fails, disputes will be submitted to the competent court.
