Terms and Conditions

Article 1 - Definitions

  1. Blooms: the online webshop offering flowers and related products.
  2. Customer: the natural or legal person entering into an agreement with Blooms.
  3. Agreement: the purchase agreement between the customer and Blooms.
  4. Products: all items offered by Blooms on the webshop.
  5. Cooling-off period: the period within which the customer can exercise the right of withdrawal.
  6. Right of withdrawal: the possibility for the customer to withdraw from the agreement within the cooling-off period.

Article 2 - Applicability

  1. These terms and conditions apply to all orders and agreements via the Blooms webshop.
  2. By placing an order, the customer accepts these terms and conditions.
  3. Deviations from these terms are only valid if agreed upon in writing.

Article 3 - Offer and Agreement

  1. All offers on the webshop are non-binding and may be changed at any time.
  2. An agreement is established when the customer places an order and Blooms confirms it.
  3. Blooms reserves the right to refuse an order or impose additional conditions.

Article 4 - Prices and Payment

  1. All prices on the webshop include VAT and exclude shipping costs, unless otherwise stated.
  2. Payment can be made via the payment methods offered on the webshop.
  3. The order will only be shipped after full payment is received.

Article 5 - Delivery and Shipping Costs

  1. Blooms aims to deliver the order within the specified delivery time.
  2. Shipping costs are clearly stated during the ordering process.
  3. If delivery is delayed, the customer will be informed.
  4. The risk of damage or loss of products transfers to the customer upon delivery.

Article 6 - Right of Withdrawal and Returns

  1. The customer has the right to withdraw from the agreement within 14 days of receipt without providing reasons.
  2. During the cooling-off period, the customer must handle the products with care.
  3. Return shipping costs are borne by the customer unless otherwise agreed.
  4. Flowers and perishable products are excluded from the right of withdrawal.

Article 7 - Complaints and Warranty

  1. Blooms strives to deliver products in optimal condition.
  2. Complaints about delivered products must be reported within 48 hours of receipt.
  3. If a product is defective, Blooms will offer an appropriate solution.

Article 8 - Liability

  1. Blooms is not liable for damage caused by improper use of the products.
  2. Blooms' liability is limited to the purchase price of the respective product.

Article 9 - Force Majeure

  1. In case of force majeure, Blooms has the right to suspend or terminate the agreement without compensation.

Article 10 - Privacy and Data Protection

  1. Blooms processes personal data in accordance with applicable privacy legislation.
  2. Data will not be shared with third parties unless necessary for the execution of the agreement.

Article 11 - Applicable Law and Disputes

  1. These terms and conditions are governed by Dutch law.
  2. Disputes will preferably be resolved through mutual consultation. If this fails, disputes will be submitted to the competent court.
